These Terms of Service ("Terms") govern your use of the Empire Builder Hub website and services offered by FitWell.Life LLC, doing business as Empire Builder Hub ("Empire Builder Hub," "we," "us," or "our"). By using the website, booking an appointment, purchasing a service, or otherwise engaging with us, you agree to these Terms.
1. Services
Empire Builder Hub provides business strategy, marketing, advertising management, websites, customer relationship management systems, automation, content, consulting, coaching, and related services. The exact scope, timing, deliverables, and fees for a client engagement may be described in a proposal, order form, checkout page, statement of work, or separate agreement. If those terms conflict with these Terms, the engagement-specific terms control.
2. Eligibility and accurate information
You must be at least 18 years old and able to enter a binding agreement. You agree to provide accurate, current information and to maintain the security of any account credentials or access you provide for service delivery.
3. Fees, billing, and cancellation
Fees and billing frequency are shown at checkout or in your engagement documents. Recurring services continue until canceled according to the applicable offer or agreement. Unless otherwise stated, cancellation stops future renewal charges and does not refund amounts already paid or costs already incurred.
Advertising budgets are separate from management fees and are generally paid directly to the advertising platform. You remain responsible for approved third-party costs, platform charges, taxes, and overdue balances.
4. Client responsibilities
You are responsible for timely access, accurate business information, required approvals, lawful offers and claims, rights to materials you provide, and reasonable cooperation. Delays in access, content, payment, or approval may affect schedules and results.
5. Results and professional judgment
Marketing and business outcomes depend on many factors outside our control. We do not guarantee leads, revenue, rankings, advertising performance, or any specific result. Information on this website is general business information and is not legal, tax, accounting, or financial advice.
6. SMS terms
When you provide your mobile number and expressly opt in through our chat widget or another approved method, you agree to receive text messages from Empire Builder Hub regarding your inquiry, appointments, service updates, follow-up, and, when separately authorized, promotional offers. Consent is not a condition of purchase.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for assistance. Carriers are not liable for delayed or undelivered messages. Your mobile information and opt-in consent are handled as described in our Privacy Policy.
7. Intellectual property
The website, brand, strategy frameworks, text, graphics, software, and other materials we create or provide are protected by intellectual property laws. Empire Builder Hub will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the website or services.
To the fullest extent permitted by law, our total liability for a claim will not exceed the amount you paid us for the service giving rise to that claim during the three months before the event giving rise to liability.
11. Indemnification
You agree to defend and indemnify Empire Builder Hub and FitWell.Life LLC from claims, losses, and expenses arising from materials or instructions you provide, your unlawful use of the services, your violation of these Terms, or your violation of another person’s rights.
12. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any dispute will be brought in a court of competent jurisdiction in Missouri unless the parties agree to another resolution process.
13. Changes and severability
We may update these Terms as our services or legal requirements change. Continued use after an update constitutes acceptance of the revised Terms. If any provision is unenforceable, the remaining provisions remain in effect.
